У відповідності до Закону України «Про публічні закупівлі» (далі – Закон), замовники – це органи державної влади (орган законодавчої, органи виконавчої, судової влади), та правоохоронні органи держави, органи влади Автономної Республіки Крим, органи місцевого самоврядування, об’єднання територіальних громад. Замовник під час проведення даної процедури закупівлі керується чинним законодавством України.
Загальний порядок, умови надання та отримання банками гарантій/контргарантій та їх виконання регулюється Положенням про порядок здійснення банками операцій за гарантіями в національній та іноземних валютах (далі – Положення), що затверджене Постановою Правління Національного банку України від 15.12.2004 № 639 і Зареєстровано в Міністерстві юстиції України 13 січня 2005 р. за № 41/10321. Дане Положення розроблено відповідно до Цивільного кодексу України, Законів України "Про Національний банк України", "Про банки і банківську діяльність", "Про фінансові послуги та державне регулювання ринків фінансових послуг", "Про валюту і валютні операції", інших законодавчих актів України та нормативно-правових актів Національного банку України. Згідно підпункту 9 пункту 3 розділу І Положення, гарантія – спосіб забезпечення виконання зобов'язань, відповідно до якого банк-гарант бере на себе грошове зобов'язання перед бенефіціаром сплатити кошти в разі настання гарантійного випадку. Зобов'язання банку-гаранта перед бенефіціаром не залежить від базових відносин, які забезпечуються такою гарантією (їх припинення або недійсності), зокрема і тоді, коли посилання на такі базові відносини безпосередньо міститься в тексті гарантії. Базові відносини – це відносини між принципалом та бенефіціаром, які виникають на підставі договору, інших правочинів, тендерної документації, законодавчих актів щодо зобов'язань принципала на користь бенефіціара, виконання яких забезпечує гарантія.
Згідно умов тендерної документації та частини шостої статті 25 Закону, в разі настання гарантійного випадку кошти, що надійшли як забезпечення тендерної пропозиції, якщо вони не повертаються учаснику у випадках, визначених Законом та тендерною документацією, підлягають перерахуванню до відповідного бюджету (розрахунковий рахунок замовника) у розмірі 1 059 393,00 гривень.
Враховуючи, що: розрахунковий рахунок замовника відкрито лише у національній валюті гривня; фінансування даної закупівлі проводиться у національній валюті гривня; валюта, у якій буде здійснюватись розрахунок за договором про закупівлю – гривня; в разі настання гарантійного випадку за забезпеченням тендерної пропозиції, перерахунок коштів до відповідного бюджету буде здійснюватись у національній валюті гривня, замовник не має можливості встановити в забезпеченні тендерної пропозиції іншу валюту, ніж гривня.
Надання гарантій за тендерними пропозиціями учасникам публічних закупівель, які є нерезидентами у більшості випадків здійснюватимуть саме банки-нерензиденти, лише сплата коштів може бути здійснена банком-резидентом у разі наявності контргарантії. Детальніша процедура оформлення гарантії/контргарантії передбачена Положенням.

In accordance with the Law of Ukraine "On Public Procurement" (hereinafter - the Law), customers are state authorities (legislative, executive, judicial authorities), and law enforcement agencies of the state, authorities of the Autonomous Republic of Crimea, local authorities, associations of territorial communities. The Customer shall be guided by the current legislation of Ukraine during this procurement procedure.
The general procedure, conditions for granting and receiving guarantees/guarantees by banks and their implementation are regulated by the Regulation on the procedure for banks to carry out transactions on guarantees in national and foreign currencies (hereinafter - the Regulation), approved by Decree of the Board of the National Bank of Ukraine dated 15.12.2004 No. 639 and registered with the Ministry of Justice of Ukraine on January 13, 2005 No. 41/10321. This Regulation was developed in accordance with the Civil Code of Ukraine, the Laws of Ukraine "On the National Bank of Ukraine," "On Banks and Banking Activities," "On Financial Services and State Regulation of Financial Services Markets," "On Currency and Currency Transactions," other legislative acts of Ukraine and regulatory acts of the National Bank of Ukraine. According to paragraph 3 (9) of section I of the Regulations, a guarantee is a way of ensuring the fulfillment of obligations, according to which the guarantor bank assumes a monetary obligation to the beneficiary to pay funds in the event of a guarantee event. The obligation of the guarantor bank to the beneficiary does not depend on the basic relations that are provided by such a guarantee (their termination or invalidity), including when a reference to such basic relations is directly contained in the text of the guarantee. The basic relationship is the relationship between the principal and the beneficiary, which arises from the contract, other transactions, tender documents, legislative acts regarding the obligations of the principal in favor of the beneficiary, the fulfillment of which is guaranteed.
According to the terms of the tender documentation and Part 6 of Article 25 of the Law, in the event of a warranty event, the funds received as security for the tender offer, if they are not returned to the participant in cases determined by the Law and the tender documentation, are subject to transfer to the appropriate budget (customer's settlement account) in the amount of 1,059,393,00 UAH.
Considering that: the customer's settlement account is opened only in the local currency of hryvnia; financing of this purchase is carried out in local currency hryvnia; currency in which settlement will be made under the purchase contract - hryvnia; in the event of a guarantee case for the provision of a tender offer, the allocation of funds to the corresponding budget will be carried out in the local currency of the hryvnia, the customer is not able to establish a different currency than the hryvnia in the provision of the tender offer.
The provision of guarantees on tender offers to participants in public procurement, who are non-residents in most cases will be carried out by non-resident banks, only the payment of funds can be made by the resident bank in the event of a counter-guarantee. A more detailed procedure for issuing a guarantee/counter guarantee is provided for in the Regulation.
